Intellectual Property Policy: Your Copyrights and Trademarks

Zamroo is committed to removing infringing products from its platform. To facilitate this, Zamroo has put in place Zamroo’s Copyright & Infringement Policy so that intellectual property owners could easily report listings that infringe their rights.
If we receive proper notification of Copyright Infringement, our response to such notices will include removing or disabling access to the material claimed to be the subject of infringing activity.
This policy is part of and incorporates by reference all terms, conditions rules, policies and guidelines on the Site, including the Terms of Service. Your continued use of the Site after that will signify your acceptance of this Policy.
1. Intellectual Property Rights
All information, data, text, software, music, sound, photographs, graphics, video, messages or other materials ("Content"), whether publicly or privately transmitted / posted, is the sole responsibility of the person from where such content is originated (the Originator). By Posting any material which contain images, photographs, pictures or that are otherwise graphical in whole or in part ("Images"), you warrant and represent that (a) you are the copyright owner of such Images, or that the copyright owner of such Images has granted you permission to use such Images or any content and/or images contained in such Images consistent with the manner and purpose of your use and as otherwise permitted by these Terms of Services, (b) you have the rights necessary to grant the licenses and sublicenses described in these Terms of Service, and (c) that each person depicted in such Images, if any, has provided consent to the use of the Images as set forth in these Terms of Service, including, by way of limitation, the distribution, public display and reproduction of such Images.
You represent that you have valid rights and title in any and all Content/Images that you submit on the Site, that you have not infringed on any IPR belonging to any party and further that you will indemnify Codera Technologies or its affiliates for all claims arising out of any content that you post on the Site.
Posting/uploading of any information or material, which is harmful, defamatory, obscene, pornographic, libellous, invasive of another's privacy, profane, hateful, or racially, ethnically objectionable, disparaging, or otherwise unlawful in any manner is prohibited and any person found to be involved in such activity on this website will solely be liable for actions under the applicable laws.
Zamroo.com or its parent entity accepts no responsibility for the said Content / Images. However, you understand that all Content / Images posted by you becomes the property of Codera Technologies and you agree to grant/assign to Codera Technologies and its affiliates, a non-exclusive, royalty free, perpetual, irrevocable and sub-licenseable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such Content / Images (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed throughout the world".
2. Copyright ownership
Unless otherwise stated, copyright and all intellectual property rights in all material presented on the site (including but not limited to text, audio, video or graphical images), trademarks and logos appearing on this site are the property of Zamroo.com, its parent, affiliates and associates and are protected under applicable Indian laws. You agree not to use any framing techniques to enclose any trademark or logo or other proprietary information; or remove, conceal or obliterate any copyright or other proprietary notice or any credit-line or date-line on other mark or source identifier included on the Site / Service, including without limitation, the size, color, location or style of all proprietary marks. Any infringement shall be vigorously defended and pursued to the fullest extent permitted by law.
3. How to report a listing
Zamroo has implemented procedures for receiving written notification of claimed infringements of copyrights, and for processing such claims in accordance with the Copyright Act. If you believe your copyrights are being infringed by a user of the Site Services available at the domain and sub-domains of www.zamroo.com, please fill out a Copyright Infringement Form and email it to infringement@zamroo.com. To be effective under this subsection, a notification of claimed infringement must be a written communication provided to the designated agent of a Provider (Zamroo) that includes substantially the following:
- A physical signature of a person or an agent authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the Copyrighted work claimed to have been infringed, or, if multiple copyrighted listings are covered by a single notification, a representative list of listings at that Site.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the Provider to locate the material.
- Information reasonably sufficient to permit the Service provider to contact the complaining party such as an address, telephone number, and if available, an electronic mail address at which the complaining party may be contacted.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Notification from a copyright owner or from a person authorized to act on behalf of the copyright owner that fails to comply substantially with the provisions above shall not be considered as providing actual knowledge or an awareness of facts or circumstances from which infringing activity is apparent.
4. Removal of Material from the site
Once the company receives the fully completed Copyright Infringement Form, with all the necessary documents and details as stated above, Zamroo may remove or disable the alleged infringing content hosted by third parties. We will also notify to the relevant seller who submitted the allegedly infringing material and provide them the copy of the copyright infringement notice. We reserve the right to take appropriate action according to applicable local laws at the relevant point of time of notification.
5. Third Party Content
All the contents posted at Zamroo are supplied by third parties and users. Neither Zamroo nor any third-party provider of information guarantees the accuracy, completeness, or usefulness of any content, nor its merchantability or fitness for any particular purpose.
Zamroo neither endorses nor is responsible for the accuracy or reliability of any Listing, product details made on the Site by any third party. Under no circumstances will Zamroo be responsible or liable, directly or indirectly, for any loss or damage caused by your use or reliance on information obtained through the Site. Zamroo is not responsible for any actions or inaction on your part based on the information that is presented on the Site. It is your responsibility to evaluate the accuracy, completeness or usefulness of any information, opinion, advice or other content available through the Site. Please seek the advice of professionals, as appropriate, regarding the evaluation of any specific information, opinion, advice or other content.
6. Limited Permission to Copy
Contents on the Website are provided to you AS IS for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners.
Company forbids you from any attempts to resell or put to commercial use any part of the Site; any collection and use of any product listings, descriptions, or prices; any derivative use of the Site or its contents; any downloading or copying of account information for the benefit of any other seller; any renting, leasing, or otherwise transferring rights to the Site / Service; displaying the name, logo, trademark or other identifier of another person (except for zamroo.com or you) in such a manner as to give the viewer the impression that such other person is a publisher or distributor of the Service on the Site, or any data gathering or extraction tools; or any use of meta tags. You may not (whether directly or through the use of any software program) create a database in electronic or structured manual form by regularly or systematically downloading and storing all or any part of the pages from this site.
If you download or print a copy of the “Contents” for personal use, you must retain all copyright and other proprietary notices contained therein. You agree not to circumvent, disable or otherwise interfere with security related features of the Website or features that prevent or restrict use or copying of any Materials or enforce limitations on use of the Website or the Materials therein. The Service is protected to the maximum extent permitted by copyright laws, other laws, and international treaties and/or conventions. Content displayed on or through the Service is protected by copyright as a collective work and/or compilation, pursuant to copyrights laws, other laws, and international conventions.

You acknowledge that you do not acquire any ownership rights by downloading copyrighted material.
